An Ex Parte Application is an emergency filing used when a matter needs to be reviewed by the Court on shortened notice. As a legal document assistant, we do not advise whether an Ex Parte is legally appropriate, but we can assist with preparing documents strictly based on your instructions.
Ex Parte filings are time-sensitive. While each court has its own rules, many applicants prepare documents several days in advance whenever possible. From a document-preparation standpoint, it is greatly preferred that clients provide their materials and instructions at least three days before the intended filing. Requests made closer to the filing date may not be accepted due to time and volume constraints.
Some courts require that notice to the other party be given by 10:00 a.m. the court day before the Ex Parte hearing. We do not advise on whether notice is required in your specific situation, but we can provide this general procedural information so that you may determine how to proceed.
Ex Parte matters typically require notifying the other party with the date, time, and location of the intended appearance. Applicants usually provide notice by phone or email and keep a record showing when notice was attempted. You are responsible for determining the correct timing and manner of notice under the applicable rules.
⚠️ Because Ex Parte matters require strict notice and timing, requests made the day before the hearing are generally not accepted. Document preparation is typically available only when we are contacted well in advance of the required deadlines.
